Field Sobriety Tests
When you are pulled over on suspicion of drunk driving, several types of field sobriety tests can be administered, including:
- Walk and turn test: taking nine steps, counting the steps aloud, pivoting and taking nine steps back
- One leg stand test: raising one foot several inches off the ground and holding this pose for thirty seconds
- Horizontal gaze nystagmus test: following an object with your eyes
It is not unusual to fail some of these tests, even if you are not intoxicated. We will find answers to the important questions:
- Were any of your constitutional rights violated by the stop?
- Did law enforcement follow proper procedure?
- Was the breathalyzer machine calibrated properly?
- Was the breath test administered properly?
- Are you on any medications, or do you have any medical conditions that could alter a correct BAC (Blood Alcohol Content) reading?
- Are you overweight or elderly?
Our firm will thoroughly identify any inconsistencies and unlawful activity by law enforcement officials and prepare a strong defense. We also handle all issues involving Massachusetts Melanie's Law.
Do not wait to contact a lawyer in a drunk driving case, especially if you have prior convictions and could be facing felony DUI/OUI.
